1. Acceptance of Terms
By creating an account or using Access Audit, you agree to be bound by these Terms of Service. If you are using Access Audit on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
Access Audit is a web accessibility compliance platform that scans websites against WCAG success criteria, identifies violations, provides remediation guidance, and generates compliance documentation. The service is provided on a subscription basis as described on our Pricing page.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. You must provide accurate and complete information when creating your account and keep it updated.
4. Acceptable Use
You may only scan websites that you own or have explicit authorization to test. You may not use Access Audit to scan websites without authorization, perform denial-of-service attacks, attempt to circumvent rate limits, reverse engineer the platform, or resell access without a partner agreement. We reserve the right to suspend accounts that violate these terms.
5. Subscription & Billing
Paid subscriptions are billed in advance on a monthly or annual basis. You can upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of the current billing period. Refunds are handled on a case-by-case basis — contact support for assistance.
6. Intellectual Property
Access Audit and all associated intellectual property are owned by Ghost Savvy Studios. Your scan data, reports, and compliance documentation remain your property. You grant us a limited license to process your data solely for the purpose of providing the service.
7. Data & Privacy
Our collection and use of your data is governed by our Privacy Policy. By using Access Audit, you consent to the data practices described therein. We process data in accordance with applicable data protection laws.
8. Disclaimer of Warranties
Access Audit is provided "as is" without warranties of any kind. While we strive for accuracy, automated accessibility scanning cannot detect all WCAG violations. Scan results do not constitute legal advice and should not be the sole basis for compliance determinations. We recommend combining automated testing with manual review and legal counsel.
9. Limitation of Liability
To the maximum extent permitted by law, Ghost Savvy Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Access Audit. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.
10. Termination
Either party may terminate the subscription at any time. We may suspend or terminate your account for violation of these terms. Upon termination, your access to the platform will cease and your data will be retained for 30 days before deletion (unless otherwise required by law).
11. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
